It is not necessary for the plaintiff to prove that he/she had actual knowledge that the agent/employer committed the breach. The defendant is not liable for the breach if at the time of the breach he/she had given the plaintiff proper notice of the breach in writing. The plaintiff may bring an action for breach or fraud against the agent/employer for damages and for injunctive relief.
